CONCRETE SERVICES DISCLAIMER
WFG Homes Investments LLC | WFG Constructions Applicable to: Foundation Services & Cast-in-Place Concrete Services
SCOPE OF APPLICATION
This disclaimer applies to all concrete-related services provided by WFG Homes Investments LLC, operating as WFG Constructions, including but not limited to:
Foundation Services: Pile Caps, Grade Beams, Spread Footings, Stem Walls, Monolithic Slabs, and Structural Concrete.
Cast-in-Place (CIP) Concrete Services: Elevated Slabs, Tie Beams, CIP Beams, Columns, Walls, Stairs, and Structural Concrete.
By engaging WFG Constructions for any of the above services, the Client and/or General Contractor acknowledges and agrees to the terms set forth below.
1. NATURAL PROPERTIES OF CONCRETE — CRACKING & SHRINKAGE
Concrete is a natural construction material that will crack. Cracking is an inherent and expected characteristic of concrete and does not, in itself, constitute a defect in workmanship or materials. The following conditions are acknowledged as normal and are not covered under any warranty or claim:
Plastic shrinkage cracking occurring during the initial curing phase.
Thermal expansion and contraction cracking due to temperature fluctuation.
Settlement or hairline cracking in slabs, beams, walls, and footings over time.
Surface crazing or map cracking resulting from environmental exposure.
WFG Constructions takes all reasonable measures to minimize cracking through proper mix design, joint placement, and curing practices. However, WFG cannot guarantee a crack-free result and shall not be held liable for cracks that fall within industry-accepted tolerances under ACI 301, ACI 318, or applicable Florida Building Code standards.
2. SOIL & SUBGRADE CONDITIONS — OWNER/GC RESPONSIBILITY
The performance of all foundation and slab systems is directly dependent on the condition and stability of the underlying soil and subgrade. WFG Constructions performs work based on the site conditions represented at the time of contract execution and visible at the time of construction.
WFG Constructions shall not be held liable for:
Settlement, heaving, or structural movement caused by expansive, unstable, or improperly compacted soils.
Subsurface obstructions, voids, organic material, or fill conditions not disclosed prior to commencement.
Failures resulting from inadequate soil compaction or preparation performed by others.
Changes in soil bearing capacity due to groundwater, weather events, or adjacent construction activity.
It is the sole responsibility of the Client, Owner, or General Contractor to provide a geotechnical report, compaction testing results, and soil certification prior to WFG commencing any foundation or slab work. WFG Constructions is not responsible for verifying subgrade conditions unless such services are expressly included in the written Scope of Work.
3. CURING & WEATHER SENSITIVITY
Concrete placement and performance are highly sensitive to environmental conditions. WFG Constructions will make commercially reasonable efforts to schedule pours under favorable conditions; however, the following limitations apply:
WFG is not liable for surface defects, strength variances, or finish inconsistencies caused by rain, extreme heat, high winds, or cold temperatures occurring during or immediately after placement.
Cold weather and hot weather concreting practices will be employed at WFG's reasonable discretion; additional protective measures requested by the Client beyond standard practice may be subject to additional cost.
Concrete curing is a chemical process that continues for 28 days or more. Loading, traffic, or construction activity on newly placed concrete before adequate cure time is the responsibility of the party directing such activity, and WFG shall bear no liability for damage resulting therefrom.
4. THIRD-PARTY EMBEDS — PLUMBING, ELECTRICAL & HARDWARE
WFG Constructions' scope is limited to the placement and finishing of concrete as specified. WFG does not design, install, inspect, or warrant any embedded components placed by other trades, including:
Underground plumbing, conduit, or electrical sleeves.
Anchor bolts, hold-downs, post bases, or hardware installed by others.
Insulation board, vapor barriers, or waterproofing membranes furnished by the Owner or GC.
Any embed, blockout, or penetration not explicitly listed in the WFG Scope of Work.
WFG Constructions shall not be responsible for the accuracy of embed locations, depths, or sizing provided by the GC, engineer, or other trades. Any required saw-cutting, coring, or modification to concrete after placement to accommodate incorrectly placed embeds will be treated as additional work and billed accordingly.
5. WORK PERFORMED BY OTHER TRADES ON CAST-IN-PLACE CONCRETE
Cast-in-place concrete elements — including elevated slabs, tie beams, columns, walls, and stairs — are structural components. WFG Constructions disclaims all liability for damage, cracking, spalling, or structural compromise resulting from work performed by other trades on or adjacent to WFG-placed concrete after substantial completion, including but not limited to:
Core drilling, chasing, or cutting performed without engineering authorization.
Impact loading, dropped materials, or heavy equipment operation on or near CIP elements.
Welding, torch cutting, or heat application to or adjacent to concrete surfaces.
Attachment of mechanical, electrical, or plumbing systems using improper anchoring methods.
Modifications to concrete elements not reviewed and approved by the project engineer of record.
Any damage to WFG-placed concrete caused by other contractors or trades is the financial responsibility of the party that caused the damage and/or the General Contractor overseeing site operations.
6. DESIGN, ENGINEERING & SPECIFICATIONS
WFG Constructions is a concrete construction contractor. Unless expressly stated in the contract, WFG does not provide structural engineering, mix design certification, or construction administration services. All concrete work is performed in strict accordance with the drawings, specifications, and engineering documents provided to WFG. Any errors, omissions, or ambiguities in the project documents are outside WFG's responsibility unless WFG is notified in writing and an agreed-upon resolution is documented prior to construction.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by Florida law, WFG Constructions' total liability arising out of or related to concrete services shall not exceed the total contract value paid by the Client for the specific scope of work in question. WFG shall not be liable for consequential, incidental, indirect, or punitive damages of any kind.
*This disclaimer is incorporated by reference into all WFG Constructions proposals, contracts, and Scopes of Work involving concrete services. Questions regarding specific conditions or exceptions should be directed to WFG management prior to contract execution.
